1. Nature of the Waitlist

By joining the Nestyd waitlist, you register your interest in a platform currently under development. Joining does not:

• Create any commercial purchase, contract, or subscription agreement.
• Guarantee immediate or future access to the platform upon launch.
• Guarantee that the product will launch or retain any specific previewed feature, pricing model, or design standard.

2. Eligibility

Participation in the waitlist is open to individuals who are at least 18 years of age and legally competent to enter into binding contracts under the Indian Contract Act, 1872. If you register on behalf of a corporate entity, you warrant that you hold the legal authority to bind that entity.

3. Early-Access Credits

We may offer promotional waitlist credits (e.g., up to 200 credits for completing email and optional phone registrations) as an early-bird incentive. The following terms govern these credits:

• No Cash Value: Credits are promotional markers with zero cash or monetary value and cannot be redeemed for fiat currency, cash, or transferred to other accounts.
• Redemption Scope: These credits are solely usable within the official Nestyd platform when it is fully launched, subject to our final platform service terms.
• Revocation Rights: We reserve the right to cancel, modify, cap, or invalidate waitlist credits at our sole discretion, specifically in cases of registration abuse, invalid emails, or spam.
• Expiry: Waitlist credits are valid only if the Nestyd platform launches and the user creates an account within 24 months of the platform's public launch date. Credits that are not claimed within this window will expire automatically with no compensation or equivalent offered.
• Platform Non-Launch: If Nestyd does not proceed to a public launch, all waitlist credits become void. No monetary compensation or alternative will be provided in such circumstances.

4. Acceptable Use

You agree to use this website in a lawful manner. In particular, you shall not:

• Use automated scripts, bots, spiders, or multiple fake accounts to register for the waitlist or manipulate waitlist stats.
• Attempt to bypass security features or reverse-engineer the site.
• Submit misleading, fraudulent, or harmful information in the waitlist fields.

Violation of these rules will result in immediate disqualification and removal of your registration and associated credits.

5. Intellectual Property

All content on this website, including but not limited to the brand name "Nestyd", logos, custom graphics, SVG mandala designs, user interface code, and text copy, is the exclusive intellectual property of Nestyd. You are not granted any license or permission to use, replicate, distribute, or modify these assets for any commercial or non-commercial purposes without our express written consent.

6. Privacy

Your registration on the waitlist is governed by our Privacy Policy, which details our data protection obligations under the DPDP Act, 2023. Please review the Privacy Policy for details on how we store and handle your contact information.

7. Limitation of Liability

This website is provided on an "as-is" and "as-available" basis. To the fullest extent permitted by law, Nestyd, its founders, and affiliates shall not be liable for any direct, indirect, special, incidental, or consequential damages, losses, or costs arising from your participation in the waitlist, your inability to access the site, or any updates or cancellations of the Nestyd platform launch.

8. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes, controversies, or claims arising out of or in connection with these terms or the waitlist shall be subject to the exclusive jurisdiction of the competent courts in Lucknow, Uttar Pradesh, India.

9. Indemnification

You agree to indemnify, defend, and hold harmless Nestyd and its founders, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your violation of these Terms, your misuse of this website, or your submission of false or misleading information.

10. Severability and Waiver

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be severed from the rest of these Terms, which shall remain in full force and effect. Our failure to enforce any right or provision of these Terms at any time shall not constitute a waiver of that right or provision.

11. Changes to These Terms

We reserve the right to revise these Terms and Conditions at any time as Nestyd moves from pre-launch development to official product release. Updated terms will be published on this page with the revised "Last updated" date. Your continued participation on the waitlist following any updates constitutes acceptance of the new terms.
